Terms of Service

Eligibility

These Terms of Service ("Terms") govern your access to and use of RangeIQ ("RangeIQ," "the Service," "we," "us," or "our"), operated by IQ Digital Holdings LLC, a Nevada limited liability company. By accessing or using RangeIQ, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years of age to create an account or use RangeIQ. By using the Service, you represent and warrant that you are 18 or older. RangeIQ is not directed at, and we do not knowingly collect information from, individuals under 18.

Nature of the Service; Not Gambling

RangeIQ is an educational strategy tool and software product designed to help users analyze poker situations and improve their decision-making.

You represent and warrant that any poker activity you engage in outside of RangeIQ is legal in your jurisdiction. You are solely responsible for complying with all applicable laws regarding poker, gambling, and gaming in your location. IQ Digital Holdings LLC assumes no responsibility for your compliance with such laws.

Accounts

To access paid features, you must create an account. You agree to provide accurate information, keep your credentials secure, and notify us immediately of any unauthorized access. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions, Billing, and Refunds

Plans

RangeIQ offers a free tier and paid subscription plans. Current pricing is displayed at rangeiqpoker.com/pricing. We reserve the right to change pricing with reasonable notice; existing subscribers will not be affected mid-cycle.

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through our payment processor, Paddle. By subscribing, you authorize recurring charges to your payment method until you cancel.

Cancellation

You may cancel your subscription at any time through the Paddle customer portal linked in your account. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free tier. No partial refunds are issued for unused portions of a billing period, except as described below.

Refund Policy

All sales are final. You may cancel your subscription at any time from the Paddle customer portal to stop future charges; however, no refunds are issued for past billing periods, partial billing periods, or unused portions of a subscription. Because the free tier does not expire and does not require a payment method, you have ample opportunity to evaluate RangeIQ before any payment is taken.

This policy is without prejudice to any non-waivable consumer rights you may have under applicable law in your jurisdiction. Where local law requires that a refund be available (for example, certain mandatory cooling-off periods under EU consumer law), our payment processor Paddle handles such requests in accordance with that law.

Failed Payments

If a payment fails, we will attempt to retry the charge according to Paddle's standard dunning schedule. If payment cannot be collected, your subscription will be suspended and your account will revert to the free tier until payment is resolved.

Acceptable Use

You agree not to engage in, attempt, encourage, or assist any of the following:

• Use RangeIQ for any unlawful purpose or in violation of any applicable law, regulation, or third-party right
• Account sharing or resale: share, sell, lease, transfer, or otherwise grant access to your account credentials to any other person, or allow more than one person to use a single account
• Multiple accounts: create more than one account, or create accounts using disposable, temporary, or fraudulent email addresses, in order to circumvent free tier limits, trial periods, or other restrictions
• Reverse engineering: reverse engineer, decompile, disassemble, or attempt to derive or extract the source code, algorithms, opponent models, training data, or trained models underlying the Service
• Automated access: use any robot, spider, scraper, bot, script, or other automated means to access, query, monitor, or copy any portion of the Service or its outputs without our express prior written permission
• Scraping or systematic copying: scrape, harvest, index, mirror, or systematically extract or copy the recommendations, reasoning, range data, drills, vault entries, or other content produced by or contained within the Service
• Competing or derivative use: use the Service or its outputs to develop, train, fine-tune, evaluate, or improve any competing product, machine learning model, AI system, dataset, or service
• Resale or repackaging: resell, sublicense, redistribute, repackage, or commercially exploit RangeIQ or any portion of its outputs without our prior written permission
• Affiliate fraud: generate fraudulent, self-referred, or incentivized affiliate referrals, or otherwise manipulate the affiliate program
• Unauthorized promotional codes: acquire, use, distribute, or sell promotional, comp, or redemption codes through unauthorized channels, or use codes obtained through deception, interception, or breach of confidentiality
• Interference: interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, our infrastructure, our security systems, or other users' accounts or data
• Misrepresentation: impersonate any person or entity, misrepresent your affiliation with any person or entity, or otherwise engage in identity-based deception in connection with the Service
• Harm to others: use RangeIQ to harass, defraud, threaten, or harm other users, our staff, or any third party

Enforcement and Termination for Violation

We reserve the right, in our sole discretion, to investigate suspected violations of this Acceptable Use section. Where we determine that a violation has occurred or is reasonably likely to have occurred, we may take any action we consider appropriate, including: issuing a warning; suspending or terminating your account immediately and without prior notice; revoking promotional grants; reversing affiliate commissions; reporting conduct to law enforcement or other appropriate authorities; and pursuing any other remedy available at law or in equity.

Accounts terminated for violation of these Terms are not entitled to any refund, and any data associated with the account may be deleted in accordance with our Privacy Policy. The remedies in this section are cumulative and in addition to any other rights or remedies we may have.

Intellectual Property

All content, software, algorithms, engine logic, opponent models, branding, and materials provided by RangeIQ are the exclusive property of IQ Digital Holdings LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use RangeIQ for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

"RangeIQ," "Range IQ," "IQ Reasoning," "IQ Coach," "IQ Explanation," the RangeIQ logo, the tagline "Range IQ is the exploit.", the tagline "The engine locks the answer. IQ Reasoning explains it.", and related names, logos, and taglines are trademarks of IQ Digital Holdings LLC. All other trademarks referenced within the Service are the property of their respective owners. You may not use our trademarks without our prior written permission, and any unauthorized use is strictly prohibited.

User Content

You retain ownership of any hand histories, notes, or data you input into RangeIQ. By using the Service, you grant IQ Digital Holdings LLC a limited license to process, analyze, and store your inputs solely for the purpose of providing the Service to you. We do not claim ownership of your personal poker data.

Disclaimers

RANGEIQ IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

RangeIQ's recommendations are based on mathematical models and heuristic analysis. We make no guarantee of any financial, competitive, or personal outcome from using the Service. Poker involves risk and variance; no software can eliminate losses or guarantee wins. Use RangeIQ as one tool among many, not as a substitute for your own judgment.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IQ DIGITAL HOLDINGS LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR POKER WINNINGS, ARISING OUT OF OR RELATED TO YOUR USE OF RANGEIQ.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RANGEIQ IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless IQ Digital Holdings LLC and its officers, members, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of RangeIQ, your violation of these Terms, or your violation of any law or third-party right.

Termination

You may terminate your account at any time by canceling your subscription through the Paddle customer portal and contacting us at support@rangeiqpoker.com to request account deletion.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including (but not limited to) for violation of these Terms or our Acceptable Use rules, for non-payment, for fraudulent or abusive activity, or where we are required to do so by law. Where reasonable and not prohibited by law, we will provide notice of termination by email.

Upon termination: (a) your right to access and use the Service ceases immediately; (b) any subscription fees previously paid are non-refundable, except where required by applicable law; (c) we will retain or delete your data in accordance with our Privacy Policy; and (d) the sections of these Terms that by their nature should survive termination — including without limitation Intellectual Property, User Content, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution — will survive.

Dispute Resolution; Binding Arbitration; Class Action Waiver

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be seated in Clark County, Nevada, and conducted in English. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AND IQ DIGITAL HOLDINGS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Carve-Outs

Notwithstanding the arbitration requirement, either party may: (a) bring an individual action in small claims court; and (b) seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@rangeiqpoker.com within 30 days of first accepting these Terms. Your notice must include your name, account email, the subject line "Arbitration Opt-Out," and a clear statement that you wish to opt out of arbitration.

Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. Subject to the arbitration provisions above, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to personal jurisdiction in those courts.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted at rangeiqpoker.com/terms with an updated "Last Updated" date. Continued use of RangeIQ after changes take effect constitutes acceptance of the updated Terms.
